Probate Real Estate Guide — New Jersey

What you need to know about selling estate property in NJ

What is Probate Real Estate?

Probate real estate involves selling property that is part of a deceased person's estate. In New Jersey, this requires going through the Bergen County (or applicable county) Surrogate's Court to establish legal authority to sell.

Key Steps

  1. File the will with the county Surrogate's Court
  2. Obtain Letters Testamentary (grants executor legal authority)
  3. Notify creditors (mandatory 6–9 month period in NJ)
  4. Obtain estate property valuation
  5. Prepare and sell the property
  6. Distribute proceeds to beneficiaries

Special Considerations in NJ

  • NJ inheritance tax applies to non-spouse, non-lineal heirs
  • Stepped-up basis means heirs only pay capital gains on appreciation after death
  • Court approval may be required for the sale price in some estates
  • Out-of-state executors must appoint a NJ agent of process
